These Terms of Service (“Terms”) govern your access to and use of NicheFox (the “Service”), operated by NicheFox (“NicheFox,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and to keep it current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
NicheFox provides software that helps small and hyper-niche businesses identify relevant online communities, build familiarity with prospective customers, and draft outreach and content with the assistance of artificial intelligence. All AI-generated drafts are suggestions that you review and approve before any action is taken. The Service does not guarantee any specific business outcome, reply rate, or revenue.
The Service helps you engage on third-party platforms such as LinkedIn and Reddit. Your use of those platforms is governed by their own terms of service and policies. You are solely responsible for ensuring that your activity complies with the rules of any third-party platform you use. NicheFox is not affiliated with, endorsed by, or sponsored by LinkedIn, Reddit, or any other platform, and we are not responsible for actions those platforms may take against your accounts.
You agree not to use the Service to: (a) send spam, unsolicited bulk messages, or deceptive communications; (b) harass, abuse, or harm others; (c) violate any law or the rights of any third party; (d) impersonate any person or entity; (e) reverse engineer, scrape, or attempt to gain unauthorized access to the Service; or (f) use the Service in a way that could disable, overburden, or impair it. We may suspend or terminate accounts that violate this section.
Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Annual plans may be refunded on a pro-rata basis for unused full months. Fees are stated in U.S. dollars and are exclusive of applicable taxes. We may change our prices with notice; changes will not affect the billing period already paid for.
We may offer free trials or free tools (such as the niche map). Free trials convert to paid plans only if you choose to subscribe. We reserve the right to modify or discontinue free offerings at any time.
Certain features consume usage credits included with your plan. Unused credits may roll over for a limited period as described on our pricing page. Credits have no cash value and are non-transferable and non-refundable except as required by law.
The Service, including its software, design, and branding, is owned by NicheFox and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of the content you create, and you grant us a limited license to process it solely to provide the Service.
The Service uses third-party artificial intelligence models to generate suggestions. AI output may be inaccurate, incomplete, or inappropriate for your situation. You are responsible for reviewing all output before using it. NicheFox makes no warranty regarding the accuracy or suitability of AI-generated content.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHEFOX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which NicheFox is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there.
